Terms and Conditions for LivinginNL.nl

Effective Date: February 2026

Welcome to LivinginNL.nl. We provide an automated roadmap and comparison tools to help you navigate your move to the Netherlands. By creating a free account and accessing our member-only area, you agree to these Terms and Conditions.

1. Scope of Service: Information and Referrals

LivinginNL.nl is a free information platform. Our "Automated Roadmap" and "Administrative Clock" are tools designed to help you organize your relocation tasks.

  • Referral Only: We act as a referrer. We provide comparison tables and links to third-party "Solution" partners.

  • No Contractual Party: We are not a party to any agreement you sign with these partners. Your relationship with them is governed solely by their terms and conditions. We do not handle your payments to them, nor do we guarantee their service delivery.

2. No Financial or Legal Advice (Wft Disclaimer)

To comply with the Dutch Financial Supervision Act (Wet op het financieel toezicht – Wft):

  • Non-Licensed Status: LivinginNL.nl is not a licensed financial advisor or intermediary.

  • Objective Information: We provide general, objective information and comparison data. We do not provide personalized recommendations or "advice" as defined by the Wft. We do not tell you which specific service you should buy; we provide the data for you to make your own informed choice.

  • Verification Requirement: You are responsible for double-checking all terms, rates, and conditions directly with the service provider before signing any contract.

3. Intellectual Property and Use Restrictions

Our "Automated Roadmap" and "Administrative Clock" represent a significant investment in research and logical structure.

  • Proprietary Structure: The logic, arrangement, and "flow" of tasks in our member area are protected by Dutch Copyright (Auteurswet) and Database Rights (Databankenwet).

  • Personal Use Only: Membership is strictly for individuals moving to the Netherlands for personal relocation purposes.

  • Competitor Prohibition: Commercial entities, competitors, or individuals acting on behalf of competing expat platforms are strictly prohibited from creating a member account.

  • Anti-Copying Clause: You may not copy, scrape, or "plunder" our database or logic to build a competing business. Any unauthorized commercial use of our structure constitutes an "unlawful act" (onrechtmatige daad) and a breach of contract.

  • Penalty: Violation of this section triggers an immediate termination of access and a fixed penalty of €5,000 per infringement, without prejudice to our right to claim full damages for loss of business logic.

4. Affiliate Disclosure and Partnerships

We remain transparent about how we keep this platform free:

  • Commissions: We may receive referral fees or commissions from our partners when you click a link or sign a contract through our platform.

  • Lead Generation: We limit our role to "lead generation" (passing your basic contact intent to a partner). We do not provide "intermediation" services that require an AFM license.

5. Limitation of Liability

  • Information "As Is": While we strive for accuracy, Dutch government policy and municipal rules change frequently. We are not liable for any inaccuracies or for any missed deadlines on your part.

  • Third-Party Performance: We are not responsible for the acts, omissions, or failures of any third-party "Solution" partner we refer you to. Any disputes regarding their service must be handled directly with that provider.

  • No Indirect Damages: We are not liable for any indirect losses, such as missed job opportunities or financial penalties you may incur from Dutch authorities.

6. Account Cancellation

Since membership is free, you may cancel your account and request the deletion of your data at any time. We reserve the right to block any user we suspect of using the platform for commercial or competitive purposes.

7. Jurisdiction

These Terms are governed by the laws of the Netherlands. Any disputes shall be submitted to the competent court in the district where LivinginNL.nl is registered.
